Dr. Nancy Macharia the TSC CEO. She says the country is faced with a shortfall of about 50,000 primary school teachers.

The commission says it has become difficult to address the teething gaps due to budgetary constraints. The commission has since started employing teachers on internships (alongside those on permanent and pensionable terms) to try and address the shortages. This is because lesser funds are required to enlist teachers’ services under the internship programme as opposed to the permanent and pensionable terms. The redeployment of teachers from primary to secondary schools has further created staffing gaps in the primary schools.

The commission uses set recruitment guidelines to ensure fairness during the process of employing new teachers. read the latest guidelines here; TSC Teachers’ mass recruitment guidelines and marking scheme.

TSC Latest Circular on Study Leave Application by Teachers and Approvals

TSC Study Leave Approved Status- If you are intending to further your studies, then you can apply for a study leave. The Application for the study leave is made to the Teachers Service Commission (TSC). Advancing your studies is one surest way of having competitive advantage during TSC promotions and it also increases your chances of landing greener pastures.

Getting a TSC study leave approval is not a walk in the park, though. This is because the Commission limits the number of teachers to proceed on study leave so as not to affect curriculum delivery as a result of reduced teaching staff.

LATEST TSC STUDY LEAVE POLICY

APPLICATION FOR STUDY LEAVE

The study leave application form has been modified to show the number of streams in a school and the number of teachers on study leave. It will apply to all teachers wishing to proceed on study leave.

On receipt of the study leave application, the Commission will decide whether one qualifies for:-

  1. Study leave with pay
  2. Study leave without pay
  3. No study leave in which case the teacher will be required to resign or be deemed to have deserted if he/she proceeds for studies.

PROCEDURE OF APPLYING FOR STUDY LEAVE

Application for study leave will be forwarded to the Commission at least three months prior to commencement of studies. Where Government scholarship is received late the Commission will consider late application.

The application form will be completed in triplicate and the copies distributed as follows:-

  • The original copy will be forwarded to TSC by The County Director.
  • The duplicate copy will be retained in the office of The County Director
  • The triplicate copy will be retained in the institution

Guidelines for study leave application

  1. Teachers will qualify for study leave only when they are attending full time
    studies.
  2. Teachers pursuing studies for their first degree will not qualify for any study
    leave.
  3. The number of teachers on study leave at any one time should not exceed 2% of
a county’s primary school’s teacher population. For post primary institutions the number will be limited to one teacher for a single streamed school, two for a double streamed school, three for a triple streamed school and four for four streams and above. There should not be more than one teacher on study leave from a department at any one time.
  4. A newly employed teacher will not qualify for study leave unless he/she has worked for the Teachers Service Commission for five years.
  5. A teacher will not qualify for study leave if he/she wishes to study in an area that
is not in the school curricula or in the Study Leave Policy.

  8. A teacher will be required to submit the certificate one year after completion or the expiry of the leave. Teachers who for any reason are unable to complete or pass their courses will be required to report back to the commission immediately and produce documentary evidence of the part of the course covered and the reasons for the inability to complete the course. A teacher who does not pass the course will not qualify for any other leave thereafter.
  9. Teachers on study leave will remain answerable to the headteacher in their duty station. For that reason teachers on study leave should report to the headteacher for assignment of duties when there are interruptions in their programmes.

Kuppet writes to TSC about move to deduct salaries of 3,500 teachers for failing to declare wealth

The Kenya Union of Post Primary Education Teachers, Kuppet, as lashed out at the teachers’ employer for threatening to expunge over 3,500 teachers and staff from the payroll. This is in response to a move by the Teachers Service Commission, TSC, to remove teachers who failed to declare their 2017/ 2019 liabilities, assets and income within the stipulated time.

“We have noted with concern that the Teachers Service Commission intends to stop the remittance of salaries to some 3,500 TSC employees, most of them teachers, for their alleged failure to file a statement of income, assets and liabilities under the Public Officers Ethics Act,” says Kuppet.

TSC on April 14, 2020, released a list of 3,500 teachers and staff who failed to declare their wealth even after extending the deadline from the earlier set date of 31/12/2019. The Commission said the affected individuals will miss their April salaries until they do a formal explanation as to why they failed to comply. Kuppet says this move has had ripple effects among the teaching circles.

“The Commission’s circular dated 14 April 2020 has caused extreme anxiety in the teaching fraternity at a time all Kenyans are dealing with the unprecedented COVID-19 pandemic. Already, too many lists are circulating on social media allegedly identifying the affected teachers,” adds Kuppet via a circular dated April 21, 2020.

According to Kuppet, it will be very difficult for the said teachers to fulfill the requirements set by TSC considering the fact that ‘schools and TSC offices around the country are currently un-operational, while many teachers have travelled far away from their stations of service.’

Borrow a leaf from other employers

The current state of the Covid-19 pandemic in the country has made life very difficult and subjecting teachers to pay cuts will only make the situation worse. kuppet advises TSC to borrow a leaf from other government arms.

“It would be insensitive on the Commission’s part to be punishing teachers during this pandemic when other government departments are issuing temporary reprieves to citizens and foreigners for non-compliance with certain protocols during this crisis. For instance, the government has extended an indefinite extension for foreign nationals whose work permits have expired,” advises Kuppet.

Accordingly, KUPPET has written to the TSC Secretary urging her to rescind the planned action of suspending salaries for any employees until after the COVID-19 pandemic is over and government operations return to normal.

2021 TSC intern extension letters

The Teachers Service Commission, TSC, has dispatched the 2021 extension of internship letters to 2020 teacher interns. The Commission has decided to extend the internship contracts for 2020 interns who failed to secure permanent employment in the last recruitment exercise.

“Due to interruption caused by COVID-19 pandemic, I am pleased to inform you that your internship program is hereby extended for a period of one (1) year with effect from 1st January, 2021 to 31st December, 2021.” Reads the letter, in part.

The teacher interns will also be retained at their current teaching stations for another one year.

Earlier, the Commission had barred the current serving intern teachers from applying for the December 6,674 advertised internship posts sending panic among the affected teachers.

See also; TSC guidelines for intern teachers recruitment, score sheet and marking scheme 2020/2021.

The good news for the intern teachers is that their salaries will be scaled upwards. They will now receive a monthly stipend of Kshs. 15,000/= and Kshs. 20,000/= respectively; up from the current Sh10,000 and Sh15,000 respectively. The stipend will be paid subject to statutory deductions where applicable; like the National Hospital Insurance Fund (NHIF).

The interns though have a reason to smile as the government has exempted those earning below Sh24,000 per month from paying the Pay As You Earn (PAYE) tax.

Two learners to receive Sh5 million from TSC as defilement compensation

The Teachers Service Commission will be forced to pay a whooping sum total of Sh5 million Kenyan shillings as compensation to two pupils defiled by their head teacher. In a land mark ruling by court of appeal judges, the Commission should bear responsibility for failing to ensure safety of the learners while at school.

TSC had moved to the court of appeal to protest a ruling by high court judge Justice Mumbi Ngugi’s ruling that awarded the minors the compensation. Justice Mumbi had blamed the Commission for not instituting measures to safeguard the minors while at school. But, Court of Appeal judges Martha Koome, Roselyn Nambuye and Fatuma Sichale turned down the plea by TSC; and thus affirming Justice Mumbi’s ruling.

“As innocent victims, the minors are entitled to compensation for having been subjected to such humiliation, shame, and pain that may have a lifelong effect on them. It is inconceivable how the minors in their tender years are made to carry that kind of burden of shame due to selfishness of a caregiver,” said the Judges in a ruling read by Justice Martha Koome.

Astarikoh Henry Amkoah (a deputy head teacher at Jamhuri Primary School in Nakuru county) is said to have defiled the two minors on July 4 and 10, 2010; in his house. At that time the two girls were both in class six. In her ruling, on May 19, 2015, Justice Mumbi had found the teacher guilty.

“I award Sh2 million for the first girl and Sh3 million for the second girl who dropped out of school. I note that at the time the events the subject of this petition occurred, the petitioners were minors aged 12 and 13 respectively, and should now be aged 16 and 17 respectively. I therefore direct that the above awards, upon payment, be deposited in an interest-earning account in trust for them and be utilised to further their education or training with a view to their being able to make a sustainable living for themselves,” she ruled.

Justice Mumbi had urged the Commission to go an extra mile in dealing with sex pests at schools.

“With respect to the State through the TSC, it must up its game with respect to protection of minors. It cannot shuffle paedophiles from one school to another, and finally, content itself with dismissals. It has to put in place an effective mechanism, whether through an inspectorate department within TSC or the Quality Assurance Department within the Ministry, to ensure that no-one with the propensity to abuse children is ever given the opportunity to do so. Dismissal, and even prosecution, while important, can never restore the children’s lost innocence,” she added.

The awarded cash will be spent on the girls’ education until they complete their university studies.

The case was filed by two parents from Nakuru.

The Commission has been taking stern action against teachers accused of sexual harassment by serving them with dismissals.
