Teachers’ unions reject the new 2021-2025 CBA offer

A new 2021-2025 Collective Bargaining Agreement (CBA) counter offer by the Teachers Service Commission (TSC) has been rejected by teachers’ unions. A meeting convened by the Commission did not bore any fruits; meaning that teachers will have to wait a little bit longer for the new salary increments.

Instead of a salary hike for teachers, TSC instead reviewed the maternity and paternity leave days. According to details from the discussions, female teachers will now ‘enjoy’ an enhanced maternity leave of 120 days; up from the current 90 days.

On their part, male teachers will now proceed on a 21 days’ paternity leave; up from the current 14 days.

The Commission has at the same time offered a preadoptive leave for teachers adopting kids plus a promise to fast track promotions of teachers in arid and semi-arid areas.

Also in the TSC basket of ‘goodies’ for teachers is a transfer allowance for teachers; equivalent to one month’s salary.

But, the Kenya Union of Post Primary Education Teachers – KUPPET, and Kenya National Union of Teachers (Knut) have jointly rejected this offer by TSC; terming it a joke of the century.

Addressing the media after the collapsed talks, Kuppet Secretary General Akello Misori said teachers want nothing short of a salary increment. Misori says teachers will have to down their tools in the new term; if a new CBA would have not been signed by then.

On her part, TSC Boss Dr Nancy Macharia has urged the tutors to accept the offer saying the economy can not support a salary hike due to the ripple effects of the Covid 19 pandemic.

Already, the Salaries and Remuneration Commission (SRC) has freezed salary increment for teachers and other public servants; for a period of two years.

TSC new CBA salary scale 2021-2025

The Teachers Service Commission, TSC, signed a Collective Bargaining Agreement (CBA) with Kenya National Union of Teachers (KNUT), Kenya Union of Post Primary Education Teachers (KUPPET) and Kenya Union of Special Needs Education Teachers (KusNET) on 13th July 2021.

Consequently, the CBAs were registered   by the Employment  and Labour  Relations  Court on 27th August, 2021 as required under Section 60 of the Labour Relations Act.

Application

The CBA shall apply to all teachers in service as at 1st July, 2021 .

  1. Implementation Period

The implementation period of the CBA will commence from 1st July, 2021 to 30th June, 2025.

6. Medical benefit shall  be drawn as provided at Part  IX of Code of Regulations for Teachers (CORT).

7. Transfer Allowance  is payable  at a rate  of one month’s Basic Salary subject to the provisions of Regulation of the CORT.

Promotions

Promotions of Teachers shall be in accordance with the Career Progression Guidelines in force however teachers serving in ASAL and hard to staff areas and are holding administrative positions in an acting capacity shall be promoted progressively until they obtain grades commensurate to their respective positions.

Transfers

Transfers of teachers shall be done in compliance to Pan V of the CORT together with the obtaining polices of the Commission.

However, to achieve the family values enshrined in the Constitution, the Commission shall consider transfer requests for married couples to appropriate stations/locations subject to availability of vacancies, the need for suitable replacement, existing staffing norms and proof of marriage among other factors.

Leaves

Application for different categories of leave shall be considered and approved strictly in accordance with Part X of the CORT. However, the Commission shall grant:

  1. Maternity Leave of One hundred and twenty ( 120) Calendar days with full pay with effect from date of delivery.
  2. Pre-adoptive Leave of Forty-five (45) Calendar days with full pay with effect from the date of adoption.
  3. Paternity Leave of Twenty One (21) calendar days with full pay once a year.

Performance Management and Evaluation.

In compliance with Regulation 48 (1) of the CORT and with a view to enhance and maintain high performance standards in the teaching service, the Commission shall implement continuous the Teacher Professional Development (TPD) Programmes and Performance Management system in the teaching service.

To this end, every teacher who successfully completes the TPD programme shall be issued with a Teaching Certificate contemplated under Regulation 49 (1) of the CORT.

Career Progression.

Career Progression in the teaching service shall be based on the Career Progression Guidelines, in force.
