TSC employment confirmation letter

If you are a newly employed TSC teacher, then you will be expected to work on probation before you are employed on permanent and pensionable terms. Probation usually takes a minimum period of six (6) months but can be longer than this.

The teacher’s effective date of employment is the first day you report to duty and a casualty is sent to the Commission such that your salary is processed. At the end of your probation period, you should apply to the Commission so as your terms of employment are changed.

The application for confirmation is done in writing through your Principal/ Head Teacher. This should be done a month before expiry of the probation period.

To apply, for confirmation of employment, you are supposed to fill the ‘application for confirmation of employment form‘ and which must be endorsed by the Principal/ Head Teacher. Four copies of this form are required. Details on this form include: Teacher’s name, TSC Number, Grade (entry grade), date of appointment, name of current institution and the teacher’s self assessment report.

The Principal/ Head Teacher’s comments are very vital as TSC gives them consideration before deciding on whether to offer you permanent terms.

WHY TSC MAY FAIL TO CONFIRM YOU ON PERMANENT AND PENSIONABLE BASIS.

Remember, TSC may fail to confirm you on permanent basis if your TPAD rating is deemed to be unsatisfactory. Confirmation may also be denied if you are found guilty of any of the following;

  • If you are absconding duty without express permission,
  • When you engage in unethical conduct such as but not limited to immoral behaviour, professional misconduct and being of infamous conduct as stipulated in the Code of Regulations for Teachers, CORT,
  • Disregarding orders from your bosses,
  • If your performance is not satisfactory and not in line with the relevant provisions of the Code of Regulations and Code of Conduct & Ethics for teachers.

Once confirmed, TSC will send a confirmation letter that spells out your employment terms. At this juncture you qualify to get pension from the government but after serving for a minimum of ten (10) years or upon retirement.

TSC teacher interdiction letter

The Teachers Service Commission, TSC, may decide to reverse the interdiction of a suspended teacher. In such a case, the Commission sends a revocation of interdiction letter to the teacher.

Several reasons may make the TSC to reverse the interdiction of a teacher. A number of reasons may precipitate such a decision. These include:

  • Irregular and faulty interdictions i.e if the Commission detects malice in the allegations made,
  • Interdictions being done without adherence to the laid down procedures e.g. failing to give teachers an opportunity to appear before the investigation panel together with the accusers and witnesses to defend themselves against the allegations raised.
  • Poor and inadequate investigations at the institution/county level,
  • Delays in submission of supportive evidence e.g. availing duly signed Board Of Management minutes, statements and report in support of allegations raised.
  • Issuing casualty returns on desertion before expiry of fourteen (14) days.
  • Failure to fill in/forward casualty and casualty/ appointment returns on time.
  • Failure to carry out prompt and exhaustive/comprehensive investigations prior to interdiction.
  • Failure  to involve the Board of Management, BOM, during investigation process,
  • Failure to give specific charges on interdiction.

Upon consideration by the Commission, the teacher will receive a revocation of interdiction letter. See a sample below;

RE: REVOCATION OF INTERDICTION

Pursuant to the hearing of your discipline case on …………., I directed by the Teachers Service Commission to inform you that, the Commission carefully considered your case and has determined that you are not guilty of allegation/s made against you. Subsequently, your interdiction is hereby revoked.

Accordingly, any salary and allowances that would otherwise have been payable during
the period of your interdiction will be paid to you in full once you are reinstated on
payroll.

Please note that, payment of any salary is subject to Part VII of the Code Regulation for
Teachers and will be effective only after you report for duty and start teaching.
