Recommendations on Laws Governing Basic Education

  1. Repeal Early Childhood Education Act and transfer the provisions on ECE to the Basic Education This will align with the legal definition of basic education as starting from Pre-Primary to Senior School. In addition the amendments necessary to provide for governance and management of independently-run public ECE centres.
  2. MoE, COG and TSC to develop an intergovernmental agreement for hiring and remuneration of Pre-Primary teachers. This will ensure harmonisation of pay for all Pre- Primary teachers and that the TSC manages the payroll based on an allocation from Parliament while the Counties hire the Pre-Primary
  3. Amend Section 56 of the Basic Education Act to revise the composition of the school’s BOMs as follows:
    • For Senior School, there shall be 10 members as follows:
      • The chairperson of the PTA;
      • Three representatives of the sponsor(s) of the school, where applicable;

      • Three ex-officio members;

The new law shall include: coordinated management of bursaries and scholarships to be managed by Jomo Kenyatta Foundation to be recast as Kenya Basic Education Bursaries and Scholarships Council; a central database that captures all bursaries and scholarships; outlaw provision of bursaries and scholarships from two sources; outlaw remission of excess bursary and scholarships funds to awardees; needy students to be identified through the schools, wards, sub-county and County; and involve religious leaders, school heads and elected leaders. The Council is to be established as a semi-autonomous government agency within the State Department for Basic Education, and it shall be responsible for the following:
  • Administering the bursaries and scholarships
  • Providing the criteria for bursaries and scholarships;
  • Processing the identification of needs;
  • Keeping a database of all needy
  • Maintaining a database of institutions that provide bursaries and scholarships
  • Mobilising resources from the private sector to complement government
  • Collaborating with other agencies that provide bursaries and
  • Publish and publicize the list of awardees to avoid double
  • Reporting annually to the national and County

The composition of the Council shall include relevant government stakeholders, namely: the State Department for Basic Education; KISE; KLB; National Treasury; NGCDF; and other private sector players such as the Kenya Bankers Association (KBA) and religious groups and atleast two independent members.

Delete the provisions of Section 93 on the education appeals tribunal and establish the same in a dedicated law called the The Education Appeals Tribunal bill Attachment 3 Appendix 7.1 In the new law, expand the mandate of the tribunal to hear all administrative appeals in the education sector. Thus, the current arrangement where books are procured for schools by KICD be discontinued, and the function taken to the restructured SEPU. The Centre shall be a semi-autonomous government agency within the State Department of Basic Education, with the following membership: State Department for Basic Education; KICD; KNEC; Kenya Teacher Training College; National Treasury; and Private Schools Association.

In the KICD Act, amend Section 4 to delete the phrases “tertiary education & training” and “technical and vocational education and training” at Sub- Sections (c), (d) (vii), (g) and (l) and replace with teacher education and Amend Section 5 (2) to include the CEO of the Kenya Teacher Training College or his/her representative and the CEO of KISE or his/her representative in the membership of the governing council. Amend Section 14 to replace the “Director of the Institute” with CEO, and the same be used throughout the Act and amend Sections 17 and 18 to remove Academic Committee.
  2. In the KLB Act:
    • Review the composition of the Board of Management by amending Section 5 (1) of the Act as follows:

      • The CEO of the Kenya Literature Bureau (KLB).
    • Amend Section 5 (2) of the Act to provide that the term limits of the members of the Board shall not exceed a cumulative term of six years or a term of three (3) years and be eligible for re-appointment for one further
    • Amend Section 5 (6) of the Act to provide that the quorum of the Board shall be two-thirds of the
    • Replace the title Managing Director with Chief Executive Officer by amending Section 8 of the Act and anywhere else where the title is used in the The Act should also provide for a term of the CEO to be three
    • years and eligible for re-appointment for one further
    • Amend Section 9 of the Act to provide that the Board shall establish committees in the discharge of its
    • Delete Section 14 of the Act on the exemption from stamp
  1. In the KNEC Act, amend:
    • The title and Section 3 (1) to replace the phrase “Kenya National Examinations Council” with “Kenya National Assessment Council” and everywhere in the Act where the name of the Council appears as
    • Section 7 to provide that the chairperson and members of the Council shall serve for a term of three (3) years and be eligible for re-appointment for one further
    • Section 10 (1) (a) by deleting the phrase “tertiary” and replace with teacher education and Delete Section 40B, which provides for the establishment of the National Examination Appeals

IEBC Voter Registration Guide

1. How do you register as a voter?

      • An eligible voter must present himself or herself to the registration officer with his/her original identification documents at the designated registration centre during working hours.
      • The applicant fills the Application for Registration form (Form A)
      • Registered voters will be issued with a registration acknowledgement slip bearing the voter′s details.
      • However, this slip will not be a requirement for voting.

2. When can someone be denied registration?

      • When you are under 18 years of age
      • When you are not in possession of the original ID card or a valid Kenyan passport
      • When one is un-discharged bankrupt
      • When you have been found guilty by an election court or reported to be guilty of any election offence during the preceding five years.
      • If a competent court declares you to be of unsound mind

3. Is an eligible voter allowed to register more than once?

No! A person is only allowed to register once as a voter in a constituency or registration centre of his or her choice. It is an offence to register more than once.

4. What is the penalty of registering more than once?

Persons who have registered more than once are liable on conviction, to a fine not exceeding one hundred thousand Kenya shillings or imprisonment for a term not exceeding one year or both. Such persons shall be barred from participating in the immediate election and the next that follows.

5. Can a person transfer as a voter to another registration centre or constituency?
YES! A person may transfer as a voter to another registration centre of his or her choice within the registration period.

TULWO GIRLS HIGH SCHOOL’S BRIEF HISTORY

Tulwo Girls High School was founded in 1965 as Tulwo county primary school under District Education Board (DEB). In 1978, it was regestered as Tulwo Mixed Day Secondary school under the sponsorship of the Anglican Church of Kenya(ACK). In 1987, the school was registered as a Provincial mixed School. In 2001, it was changed to a Provincial Girls Boarding School. It is now a County Girls School.

The school is situated about 34km from Mosoriot along Mosoriot – Chepterwai road. It is in Surungai location, Kipkaren Division, Nandi North Sub-County, Nandi County. It borders Kakamega County to the west and Uasin Gishu County to the North.

The school sits on eleven acre farm acquired from the community through the help of Sirikwa County Council- currently under Nandi County. It is on high altitude area (2250m above sea level). The surrounding community practices mixed farming.

Form ones to receive 600,000 packets of sanitary towels

The American Embassy has donated 600,000 packets of sanitary towels to 357,029 needy girls in form one who were placed in public day Secondary schools.

This is in a bid to minimize absenteeism, drop out, increased teacher /learner contact hours, retention and delivery of quality learning of girls in schools.

The Ministry of Education has been coordinating the sanitary towels programme whose overall objective is to provide sanitary towels to all needy girls in public primary schools throughout the school calendar across the country.

This programme is an integral component to address access and equity issues which are part of the Ministry of Education mandate.

The intervention addresses the needs of many girls in schools whose greatest challenge is absenteeism related to their reproductive health issues.

Access to sanitary towels remains a critical challenge for many young girls in Kenya, especially during this time of COVD – 19 pandemic. In situations like this, the girls are likely to resort to unhygienic ways which could be harmful to their health and safety.

It is in the interest of the Ministry of Education to continue coordinating the programme to ensure all vulnerable and deserving girls in line with vision 2030 social pillar get increased education opportunities.

Higher Education Loans Board, HELB, to publish names of defaulters since 1975 on newspapers; This is what you should do

The Higher Education Loans Board, HELB, has given defaulters a period of 30 days to clear their outstanding loan balances. The Loans agency has threatened to publish names and photographs of all defaulters. HELB will at the same time take legal action against the defaulters.

NOTICE: PUBLISHING NAMES AND PICTURES OF UNIVERSITY LOAN DEFAULTERS

The Higher Education Loans Board (HELB) is a State Corporation established in July 1995 by an act of Parliament, the Higher Education Loans Board Act, CAP 213A of the Laws of Kenya. HELB is mandated to provide loans, bursaries and scholarship to Kenyan students pursuing higher education in recognized institutions of higher learning and to recover loaned out funds from the beneficiaries.

HELB wishes to notify the general public and loan defaulters that the HELB student loan is a government debt which should be repaid as per the terms and conditions on which it was advanced.
However, some beneficiaries who are in default have not responded to previous communication addressed to them yet the funds received from loan repayment are used to support the current needy students therefore sustained default hinders funding of other deserving Kenyan youth.

Please take note that the names and pictures of HELB loan beneficiaries who have defaulted repayment of the loan from 1975 to date shall be published in the leading newspapers after expiry of 30 days from the date of this notice and thereafter legal action may ensue against each defaulter as stipulated in the HELB Act.

Beneficiaries who are not servicing their loans are therefore advised as follows:

  1. Get in touch with HELB via dru@helb.co.ke for particulars of their loan accounts and any other inquiry.
  2. Loan status may be confirmed via the loanee portal on the website http://www.helb.co.ke; USSD Code #642# or HELB App through Google playstore.
  3. Loan Repayment Options are available online on https://www.helb.co.ke/repay-loan/

Repaying your Student Loan

Undergraduate Loan Repayment starts within one year of completion of studies or within such a period as the Board decides to recall the loan whichever is earlier. However, you can make voluntary payments before or after you complete your studies to reduce your loan balance.

Completion of Loan Repayment

Upon completion of loan repayment, kindly seek clearance from HELB. Please note that only HELB and not your employer can confirm your loan repayment status. HELB shall confirm loan repayment completion by issuing certificate of clearance. For clearance, please fill in the HELB Enquiry form.

Over Repayment

If you overpay your loan, you will receive a refund from HELB and not your employer. To claim refund, please fill in the Loan Recovery Enquiry form.

Jielimishe Loans (for salaried students)

Jielimishe Loans are due for repayment immediately upon disbursement. Successful applicants shall be notified via e-mail.

Loanee Obligations

All loanees [HELB loan beneficiaries] are required to start repayment after a period of one year on completion of studies, or within such a period as the Board may decide to recall the loan whichever is the earlier (Section 15 HELB Act). Paying the higher education loans at an early age reduces an individual’s financial burden in midlife when one is bringing up a family, paying a mortgage as well as planning for retirement. Among other advantages of paying the loans include; reduction of the number of loans that an individual has hence avoid being blacklisted with the Credit Reference Bureau (CRB) hence one can easily get a bank loan.

To ease your repayment, the Board has developed several different modes of repayment that suits the loanees who are employed and self-employed such as check off system, mobile payment that include M-Pesa, Airtel among others.

Therefore your obligation as a Loanee under the Act is to;

  • Inform the Board of your contact addresses (section 15 (a) HELB Act),
  • Begin repayment of your loan together with the interest accrued thereon (Section 15(b) HELB Act),
  • Facilitate the deduction and remittance of the loan to the Board – (Section 15 (c) HELB Act).

EMPLOYERS

Employers Obligations

The Higher Education Loans Board Act, 1995 demands that employers adhere to the law as stipulated below:

  • Disclose Loanees: Inform the Board that they have employed loanee(s). This should be done within three months from the date of employment. (Section 16(1) (a) of the HELB Act)
  • Deduct from the wages or remuneration of the loanee(s) the amount of any loan as instructed by the Board (Section 16(i)(b) of the HELB Act)
  • Discharge/remit the amount deducted from the loanee’s wages or remuneration

Applications and placement to the TVC are done through the Kenya Universities and Colleges Central Placement Service (KUCCPS) Portal. To apply for placement through KUCCPS, you need to access the student’s portal on the KUCCPS website and log in using your KCSE index number, year of examination, and passwordOnce logged in, you can explore available programs and institutions, and then submit your preferred choices. The Minimum requirements are: C- for diplomas, D+ for craft certificates and E for artisan courses. But, different Courses may have more specific requirements.

TECHNICAL AND VOCATIONAL COLLEGE FEES STRUCTURE

The annual tuition fee for TVET courses at many Kenyan Technical and Vocational Colleges (TVCs) is Ksh 67,189This includes a government capitation of Ksh 30,000 per trainee, leaving a balance of Ksh 26,420 to be paid by the student, which can be paid in installments. Additionally, students may be eligible for a HELB loan of Ksh 40,000. Other potential costs include KUCCPS registration fees, industrial attachment fees, and examination fees.

GOVERNMENT SCHOLARSHIP AND LOAN FOR TVC STUDENTS.

Following your placement, you are eligible for a Government scholarship, Loan and Bursary to assist with your educational expenses. If you need Government financial support, you MUST make an application for consideration through the official website www.hef.co.ke. In the case Government scholarship, Loan and bursary do not cover the entire cost of your program, the deficit will be met by your parent/guardian.

KUCCPS procedures for online Inter-Institution transfer

Are you dissatisfied with your Kuccps placement results and in need of university transfer? Worry no more. Here is your guide on Kuccps inter-institution transfer:

  1. The student (applicant) shall log in to their online portal and complete a transfer application
    form.
  2. Upon completion, the request shall be forwarded to the receiving institution for endorsement.
  3. The receiving institution shall endorse the transfer applications received through their institution portal and submit. Endorsement shall be done by the Head of the institution or an officer delegated to endorse on behalf of the Head of the institution.
  4. The receiving institution shall consider an application guided by the available capacity, minimum entry requirements and cut-off Points, and:
    • If accepted, the application will be forwarded to the releasing institution for consideration and endorsement.
    • If rejected, the rejected transfer request will revert to the applicant with comments from the receiving institution.
    • The institution will have seven (7) days to endorse the transfer application, failure to which the application will revert to the applicant.
  5. The Head of the current institution shall either accept or reject the request to clear the applicant for transfer taking into account any obligations owed to the institution by the applicant, and:
    • If cleared, the request is forwarded to the Placement Service for review and final approval.
    • If not cleared, the application reverts to the student with the reason provided for follow-up or appeal to the Placement Service.
  6. The current institution shall have seven (7) days to endorse the transfer application, failure to which the application shall revert back to KUCCPS for action.
  7. Thereafter, the KUCCPS CEO shall review the application, and:
    • If the application is approved, the inter-institution transfer letter will be generated automatically for download by the applicant and both the receiving and the releasing institutions through their respective portals.
    • If the application is not approved, the applicant will receive a notification with the reason for rejection.
  8. Thereafter, the applicant shall download the approved transfer letter and present it the receiving institution for admission and joining instructions.
  9. An inter institution transfer shall only be valid after approval by KUCCPS.
